Regulations of Wygonin Marina
TERMS AND CONDITIONS OF RESERVATION OF NIGHT SERVICES BY ELECTRONIC MET HOD (hereinafter referred to as the “TERMSAND CONDITIONS”).
The applicable law is Polish law, and the basis for interpretation is the Regulations in Polish.
PRELIMINARY PROVISIONS
These rules and regulations are a contractual template for reservations and define the rights and obligations of the Facility and the Client.
The condition for making a reservation is to fill out the form, read and accept the provisions of the Terms and Conditions and make payment.
The customer voluntarily makes the reservation. The facility does not charge a reservation fee.
The regulations are valid for bookings made from 01.03.2024.
The following terms used in the Regulations will have the meanings established in accordance with the following definitions:
Customer – an individual who is 18 years of age or older and has full legal capacity (consumer) or, in the case of a reservation made for a company, a person who, in connection with his/her profession or service provided to a legal person and/or an organizational unit that is not a legal person, which is granted legal capacity by law, makes a reservation on his/her behalf and for his/her benefit (not a consumer);

Online Payments – online payment method made available to the Customer by the Facility as part of the reservation process implemented by Tpay (National Payment Integrator joint-stock company with headquarters in Poznań, Andersa Square 3, 17th floor, 61-894 Poznań, https://tpay.com/user/assets/files_for_download/regulamin.pdf)
Eparagon – is a fiscal document in electronic form, the scope of which is regulated by the Value Added Tax Act of March 11, 2004, the Regulation of the Minister of Finance on cash registers and the MPiT Regulation on the criteria and technical conditions to which́ cash registers must conform.
Regulations – these Regulations.
TECHNICAL REQUIREMENTS
In order to make a reservation, an Internet connection and an e-mail account are required, to which either an e-mail confirming the reservation (in case of completion of the reservation process) or an e-mail notifying of discontinuation of the reservation (in case of non-completion of the reservation process) arrives.

RESERVATION
MOMENT OF CONCLUDING RESERVATION: A reservation is considered to be made at the moment the Facility accepts the reservation request – sending an e-mail to the Client confirming the reservation. If you do not receive an e-mail, please check SPAM messages or contact the Facility.
RESERVATION CHANGE: Customer’s reservation change includes the following steps:
The message sent to the customer will contain a link to make modifications,
Selecting the above-described option will launch the reservation management system in your browser. In the reservation management system, it will be possible to cancel and/or modify the reservation, depending on the terms of the reserved offer.
Once the modification request is sent, depending on the configuration of the offer, it will be accepted automatically, or sent to the Facility to confirm the status. Please note that until the Facility is contacted and the Facility confirms the modification, the modification is not made.
REFUSAL OF RESERVATION: The Facility reserves the right to refuse to make a reservation if there are no vacant rooms in the Facility. In such a case, the Client will automatically receive a message to the Client’s e-mail address provided in the course of the reservation that the reservation cannot be made.
CANCELLATION/RESERVATION CANCELLATION: Customer cancellation of a reservation involves the following steps:
selection of the “Modify” option in the message sent to the Client including confirmation of the reservation,
Selecting the above-described option will launch the reservation management system in your browser. In the reservation management system, select the “Cancel” option, and then describe the reason for cancellation,
After the cancellation of the reservation, the Customer will receive, at the e-mail address provided in the course of the reservation, a message including confirmation of the cancellation of the reservation, and in the case of a no-cost cancellation and prior payment for the reservation, the amount paid will be refunded to the Customer to the account from which the reservation payment was made. Please note that receipt of cancellation confirmation is equivalent to cancellation of the reservation. If you do not receive a cancellation confirmation, please check your SPAM folder and contact the Property.
RESERVATION NOTES: Comments entered on the form are in no way binding on the Facility. The Facility does not guarantee their fulfillment. The Facility reserves the right to contact the Client by e-mail or telephone to discuss them and to inform the Client of the payment (both in advance and on the day of arrival), if the fulfillment of the remarks/requests requires it and their implementation only after the approval of the Facility and the Client.
ADD-ONS: Add-ons selected in the reservation are binding on the Facility and if it is necessary to deliver them to the room, the delivery is made to the room no later than the Client’s arrival, unless the Client and the Facility agree otherwise by separate arrangement. In the case of personalizing an accessory, please contact the Facility in advance to determine the possibility of personalization (e.g. choice of types of flowers, color, etc.).
PAYMENT: The customer can pay for the reservation through Online Payments. The order involves an obligation to pay.
EPARAGON
The customer agrees to the issuance of the Eparagon, as well as the manner of its issuance, by accepting the Regulations.
The facility issues an Eparagon to the customer through the eparagony.co.uk (Spark) system and repository of electronic fiscal receipts.
Issuance of an Eparagon takes place through and at the moment of effective saving of the document in the document repository of the eparagony.pl system, the legible view of which is accessed by the Customer through a unique hyperlink provided by the Facility to the Customer’s e-mail address provided in the reservation.
In case of problems with access to a clear view of the document, the Customer should check the SPAM folder and contact the Facility immediately.
The facility may additionally send a one-time notification to the customer at the telephone number provided by the customer in the reservation to inform the customer of the fact that an Eparagon has been issued and issued.
STAY IN THE FACILITY
The terms and conditions of stay at the Facility are defined by separate Facility Regulations.
The terms and conditions of the reservation shall apply directly and in the event of any inconsistency with the terms and conditions of the Facility, they shall take precedence.
The terms and conditions of the reservation are sent by email along with the confirmation of the booking.
RIGHTS AND OBLIGATIONS
The Client agrees to abide by the terms and conditions of the Facility, including but not limited to the rules and regulations of the Facility, and to pay all dues on time, as well as to comply with all guidelines, rules and restrictions, especially those imposed by law or recommendations of relevant authorities and services, which are in effect at the Facility.
The customer is obliged to use truthful data, including personal data, which he is entitled to use.
The customer undertakes not to take any action that is inconsistent with the provisions of generally applicable law or good morals.
The facility undertakes to fulfill the terms of the reservation made.
The Facility reserves the right to block the e-mail address of a Customer who has violated the Terms and Conditions or the law.
RESPONSIBILITY
The customer is solely responsible for the choice of the reservation and its suitability for his own needs as well as those of the persons for whom he makes the reservation.
The customer is responsible for his own acts and omissions, including the provision of incorrect information or failure to comply with the Terms and Conditions.
Neither the facility nor the provider of the booking engine on the website is responsible for the interruption of the booking process at the stage of filling in the form or the so-called abandonment of the shopping cart (not completing the booking) by the Customer. It is required that the Customer start filling the reservation form again.
Departure before the reserved check-out date does not affect the price and is equivalent to a charge according to the terms of the reservation.
Neither the facility nor the booking engine provider on the website is responsible for:
incorrectly entered data by the customer,
Lack of Internet access or restrictions on its availability,
limitations and/or malfunctions of software or devices belonging to the Customer, which are the basis for making reservations,
incurred damages as well as lost profits by the Customer, which were caused by the actions and/or omissions of third parties, and which were not under the control of the Facility,
incurred damages as well as lost profits by the Customer that are caused by the occurrence of force majeure,
payments made through Online Payments.
The exclusions or limitations of liability provided for in the Regulations do not apply in cases in which, due to the content of mandatory provisions of law, it is not possible to exclude or limit liability, in particular, they do not apply to damages caused intentionally.
All claims are subject to the statute of limitations in accordance with applicable law.
ADVERTISEMENTS
The Client has the right to file a complaint and have it investigated by the Facility within the statutory period of 14 days from receipt. Please submit complaints by letter or e-mail to the address of the Facility. The complaint should include the following details of the Client: name, surname, Client’s address, e-mail address provided at the time of booking and a description of the problem that occurred.
Immediately after reviewing the complaint, the Facility will respond to the customer on the resolution. The response will be sent in the same form in which the complaint was submitted.
PERSONAL DATA AND PRIVACY
The principles of personal data processing and privacy terms are specified in the Privacy Policy on the Facility’s website.
The Facility may make available to the IT service provider for the issuance, maintenance and provision of access to the Eparagons the telephone number or e-mail address of the Customer, which may be processed for the purposes of:
Verification whether a given telephone number or e-mail address has been registered in the operating entity’s own products, and in the case of positive verification, making available within these products to the Customer the view of the Eparagons and additional information from the process of issuing them
Sending text messages and other notifications to customers confirming the issuance of an Eparagon to the IT system of the entity implementing the IT service of eparagons.
FINAL PROVISIONS
The facility has the right to make changes to the Terms and Conditions and they are effective as soon as they are updated in the reservation engine on the website, with the proviso that the Client who has made a reservation is bound by the Terms and Conditions in the version in effect on the date of acceptance of the Terms and Conditions by the Client.
If a person notes a violation of the law, the person is obliged to contact the Facility.
In matters not regulated in the Regulations, the relevant provisions of Polish law or/and regulations applicable to the place of residence of the consumer’s right shall apply.
In the event that any of the provisions of the Terms and Conditions is amended and/or invalidated by a final court decision, the remaining provisions of the Terms and Conditions shall remain in force. The Facility declares its readiness to resolve disputes amicably, including the pursuit of claims through out-of-court ADR (Alternative Dispute Resolution). The authorized entity to which a complaint can be directed depends on the choice of the consumer. The register in Poland of such entities, along with contact details and website address, can be ordered here: https://uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php Any disputes between the Facility and a Customer who started making or made a reservation not as a consumer will be resolved by the court having jurisdiction over the Facility’s registered office.
